Legal information
Track My Car is operated by ChTrackMe OÜ, an Estonian company registered under number 17530825.
Registered office: Harju maakond, Tallinn, Kesklinna linnaosa, Tartu mnt 67/1-13b, 10115, Estonia. Contact: support@trackmycar.ai.
Purpose of the service
Track My Car is a technical vehicle location, monitoring and protection service. Depending on hardware, subscription and enabled features, it may provide GPS positions, history, alerts, geofences and immobilisation features.
The service does not replace law enforcement, emergency services, insurance, certified road-safety equipment or permanent human monitoring.
User account
Users must provide accurate information and keep credentials confidential. They are responsible for actions performed from their account unless they prove a compromise not attributable to them.
If a user acts for a company, family, employer, customer or third party, they warrant that they have the required authority.
Subscription, purchase and payment
Access may require a subscription, activation pack, SIM card, tracker or other item shown during purchase.
Before any purchase, renewal or paid activation, the user must accept these Terms. Acceptance may be recorded with UTC date, version, language, document hash, IP address and user-agent.
Prices, taxes, duration and renewal conditions are shown before order confirmation. In test or simulated payment mode, validation does not mean a real external payment.
Withdrawal right
Consumers entering into a distance contract may have a fourteen-day withdrawal right under applicable law.
If the consumer requests immediate performance of a digital service or immediate access, they may have to pay for the part already supplied or lose the withdrawal right where legally permitted and all legal conditions are met.
Compatible hardware and installation
The service depends on a compatible tracker, correct installation, power supply, active SIM or connectivity, mobile network and satellite positioning.
The user must ensure lawful and safe installation. ChTrackMe is not liable for unsafe, unauthorised or non-compliant installation or unauthorised modifications.
GPS location data
GPS positions, speeds, timestamps and tracker states may be approximate, delayed, incomplete or unavailable depending on network coverage, environment, hardware and third-party services.
History may be retained, exported or deleted according to service settings, legal obligations, security and the applicable retention policy.
Secured immobilisation
Immobilisation features are available only when the vehicle, tracker, relay, network and server allow them. They may be refused, delayed or cancelled if technical or safety conditions are not met.
Automatic stopping is designed as a progressive power reduction or cut when safety conditions are satisfied, including compatible speed, for example at or below 30 km/h, and no detected dangerous area.
Immediate immobilisation - level 2
Immediate immobilisation is an advanced feature available only from the web interface for authorised level 2 or administrator accounts.
Before level 2 activation, the user must accept a specific waiver and acknowledges that the feature may send an immobilisation command without all usual automatic mechanisms.
The user must assess the situation before use and must not use it where it could endanger people, animals or property. ChTrackMe may refuse, suspend or remove this access.
Logs and evidence
Sensitive actions may be logged with UTC date, user account, IP address, IMEI, vehicle, GPS position, reported speed, command sent, acknowledgement if available, accepted terms version and technical verification data.
These logs may be retained for several years where necessary for security, evidence, defence of rights, abuse prevention or legal compliance.
Mobile app and web interface
Some features may be limited to the web interface or mobile app. Level 2 immediate immobilisation is not available in the standard mobile app or public demo accounts.
The user must keep their device, browser, app and system permissions compatible with the service.
Availability and third-party services
The service is provided as is and depends on telecom networks, satellites, hosting, email, payment providers, maps and hardware that ChTrackMe does not always directly control.
ChTrackMe does not guarantee continuous availability, absolute accuracy or uninterrupted operation.
User obligations
The user must use the service lawfully, only on vehicles they own or are authorised to track, and without infringing the rights, safety or privacy of others.
It is prohibited to bypass protections, disrupt the service, provide false information, track a person without a legal basis or use immobilisation dangerously.
Personal data
Personal data is processed to provide the service, secure accounts, manage subscriptions, send notifications, produce history, prevent abuse and comply with legal obligations.
Access, rectification, erasure, restriction, objection and portability rights may be exercised at support@trackmycar.ai. The Privacy Policy complements these Terms.
Suspension and end of service
ChTrackMe may suspend, limit or delete an account in case of unpaid amounts, fraud, security risk, unlawful use, breach of Terms, authority request or significant risk to persons, property or the service.
At the end of the account or subscription, some data may be deleted, anonymised or temporarily retained according to legal obligations, security and defence of rights.
Limitation of liability
To the fullest extent permitted by law, ChTrackMe is not liable for indirect, incidental, special, punitive or consequential damages, including loss of business, revenue, data, goodwill, profit or commercial harm.
For business users, ChTrackMe total aggregate liability is limited to the amount actually paid for Track My Car during the twelve months preceding the event giving rise to the claim.
For consumers, this limitation applies only as allowed by mandatory rules. Nothing excludes liability where prohibited by law, including intentional misconduct, gross negligence, death or personal injury, mandatory statutory guarantees or mandatory consumer rights.
Changes to the Terms
ChTrackMe may update these Terms. If a substantial change affects user rights or obligations, ChTrackMe will endeavour to inform users by appropriate means.
Where express acceptance is legally required, the user may have to accept the new version before continuing certain operations.
Governing law and jurisdiction
These Terms are governed by Estonian law, subject to mandatory consumer rules.
For business users, unless mandatory rules provide otherwise, Estonian courts have jurisdiction. Consumers retain mandatory rights of their country of residence where required by law.
